Women’s fashion company Tory Burch is suing Bluebell Accessories, a New York City-based wholesale jewelry company, for allegedly producing jewelry with a similar design to Burch’s well-known “TT” Logo.
Burch began selling jewelry with the TT Logo as early as 2004. The suit alleges that Bluebell is “using suspicious designations that are identical to, or substantially indistinguishable from, the TT Logo.”
Legal papers filed in New York federal court says that Burch’s counsel sent Bluebell a cease and desist letter in November. Bluebell responded, the suit says, but “failed to provide reliable doucmentation evdencing their purchases and sales to date, as well as the supplier of the counterfeit goods sold.”

The suit charges trademark counterfeiting, trademark infringement, trademark dilution, copyright infringement, and unfair competition arising from the sale of the earrings, necklaces, and bracelets.
Burch seeks profits from the sale of the jewelry, a permanent injunction, as well as damages and attorney’s fees.
Bluebell Accessories could not be reached for comment at press time.
