Amazon and Overstock hope to take their fight over New York state’s online sales tax all the way to the United States Supreme Court.
The two Internet sales giants have filed writs of certiorari, petitioning the nation’s highest court to consider their appeal. The online retailers have argued the New York law violates the Constitution’s Commerce Clause by subjecting online retailers to New York State taxes.
New York state has collected sales tax on online purchases made by its citizens since a law passed in 2008. In March, the New York State Supreme Court ruled that law was constitutional, swatting back a challenge from the two companies.
Amazon generally has favored seeking a federal solution for the sales tax issue. Overstock largely opposes any attempt to collect online sales tax.
New York and Washington state are currently the only two states where e-tailer Blue Nile charges sales tax.
